
General Terms and Conditions
§ 1 general provisons, scope of application

These general terms and conditions (hereinafter referred to as “Terms and Conditions”) apply to all business relationships between The MoMo Method (hereinafter referred to as “Provider”) and its customer in the version valid at the time the contract is concluded.

Differing general terms and conditions of the customer will be rejected.

Both consumers and entrepreneurs are considered customers according to §1 (1). A consumer is any natural person for whom the purpose of the order cannot be attributed to a commercial, self-employed or freelance activity. An entrepreneur, on the other hand, is a natural or legal person or a partnership with legal capacity that appoints for commercial, self-employed or freelance purposes.
§ 2 Ordering one-off deliveries and conclusion of the contract

The presentation of the goods in the online shop does not constitute a binding offer from the provider to conclude a purchase contract. The customer is simply asked to submit an offer by placing an order. The customer can view past orders in their user account.

When you select one or more products, the latter are placed in the virtual shopping cart. All products assigned to it can be viewed in the shopping cart. In addition, the number of products ordered can be changed and an ordered product can be removed. By clicking the “Checkout” button, you will be asked to enter the information relevant to shipping and to select a payment method. Before completing the order, you will be shown a summary of all information relevant to the order. By clicking the “buy now” button, the ordering process will be completed and the order will be sent.

By submitting the order in the online shop, the customer makes a binding offer aimed at concluding a purchase contract for the goods contained in the shopping cart. By submitting the order, the customer also accepts these terms and conditions as solely relevant to the legal relationship with the provider.

The provider confirms receipt of the customer's order by sending a confirmation email. This order confirmation does not yet represent acceptance of the contract offer by the provider. It merely serves to inform the customer that the order has been received by the provider. The declaration of acceptance of the contractual offer takes place within two days through the delivery of the goods or an express declaration of acceptance.

Deviating from §2 (4), when purchasing in advance, the order confirmation also represents acceptance of the contract offer.
§ 3 Ordering, termination and conclusion of the contract

§ 4 Costs

The prices listed for the products at the time of ordering apply to orders. All prices mentioned do not include sales tax in accordance with the regulations for small businesses, Section 19 Paragraph 1 UStG, and do not include shipping costs. Additional costs will be charged separately.
§ 5 Delivery Conditions

For delivery within the EU, shipping costs of €6.19 will be charged for goods, depending on delivery location. Informations while checkout. The delivery costs for deliveries (also outside EU) carried by orderer.

The provider is entitled to make partial deliveries and partial services. The provider bears any costs incurred.

Shipping within the EU is carried out by DHL. The provider ships daily from Mon - Sat, except on public holidays in the respective countries.

If a buyer does not accept the goods, the provider can sell the goods to a third party after a period of 2 weeks and hold the original buyer liable for any loss that may arise.

If the goods cannot be delivered due to force majeure or product discontinuation or if the provider cannot procure the ordered products under reasonable conditions and if these circumstances only arise after the contract has been concluded and are not the responsibility of the provider, the provider is released from the delivery obligation. If events occur that make delivery significantly more difficult or impossible for the provider - for example strikes, lockouts, official orders or similar - the provider is not responsible for delays, even if deadlines and dates have been bindingly agreed.
§ 6 Terms of payment
For one-off orders that do not constitute subscriptions, we offer invoice, credit card (Visa, Mastercard), PayPal and instant transfer and online transfer as payment methods. We reserve the right to exclude certain payment methods.
If you pay by credit card, the amount will be reserved when you complete the order and your account will be debited when the goods are shipped. Credit card billing is processed by:

purchase by Pay Pal; You pay the invoice amount via the online provider Paypal. You must be registered there or register first, authenticate yourself with your access data and confirm the payment instruction (except for guest access). You will receive further information during the ordering process.

purchase by instant transfer: We also offer instant transfer. We receive the transfer credit immediately. This speeds up the entire ordering process. All you need is your account number, bank code, PIN and TAN. In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Instant transfer automatically makes a transfer to your online bank account in real time. The purchase amount is transferred immediately and directly to Klarna. If you choose instant transfer as the payment method, a pre-filled form opens at the end of the ordering process. You now have to select the country in which you have your online banking account and enter the bank code. Then enter the same data as when registering for online banking (account number and PIN). purchase by credit card: When paying by credit card, we accept Mastercard and Visa. Your credit card will be charged immediately upon successful completion of the order in our online shop. You can be sure that we handle your data carefully and only transmit it using SSL encryption.
§ 7 passing of risk

For customers, the risk of unforeseeable loss and accidental deterioration of the ordered goods passes to the customer or a recipient designated by the customer when they are handed over. This applies regardless of whether shipping is insured or not. In all other cases, the risk of unforeseeable loss and accidental deterioration of the ordered goods passes to the buyer upon handover, or in the case of mail order purchases, upon delivery of the goods to the freight forwarder or the person or institution otherwise designated to carry out the shipment.
§ 8 Retention of title

For consumers, we reserve ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security interests are transferable to third parties.
§ 9 Maturity

Payment of the purchase price is due upon conclusion of the contract.
§ 10 Warranty/defects

The statutory warranty rules apply. Important note: Please consult your doctor if you have any known intolerances. The same applies to possible interactions with other products you take at the same time.
§ 11 Disclaimer

Claims for damages by the customer are excluded unless otherwise specified below. The above exclusion of liability also applies in favor of the provider's legal representatives and vicarious agents if the customer asserts claims against them.

Claims for damages due to injury to life, body or health and claims for damages due to the violation of essential contractual obligations are excluded from the exclusion of liability specified in Section 1. Essential contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract, e.g. the provider must hand over the item to the customer free of material and legal defects and obtain ownership of it. Also excluded from the exclusion of liability is liability for damages that are based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.
§ 12 Assignment and pledge ban

The assignment or pledging of claims or rights to which the customer is entitled vis-à-vis the provider is excluded without the consent of the provider, unless the customer can prove a legitimate interest in the assignment or pledging.
§ 13 Offsetting and right of retention

The customer only has the right to offset if the claim for offset has been legally established or is undisputed. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

§ 14 Cancellation policy
You have the right to cancel this contract within fourteen days without giving any reasons.
The cancellation period is fourteen days:

In the case of a sales contract, from the day on which you or a third party named by you who is not the carrier has or has taken possession of the goods.

In the case of a contract for several goods that were ordered as part of a single order and which are delivered separately from the day on which you or a third party named by you, which is not the carrier, has or has taken possession of the last goods.

§ 16 Legal liability for defects

Statutory liability for defects applies to all of our products.
§ 17 Money-back-guarantee

Beyond the statutory cancellation period, the customer has the option of returning the products within 16 days with a right to a refund of the purchase price. The period begins after receipt of the goods and after the statutory cancellation period has expired.

The customer is only entitled to the money-back guarantee if the product has been used to no more than a third of the original contents and if the document downloadable from the following link has been completed. The document contains all further details for proper execution. The goods must be returned at the customer's expense.

After the goods have been successfully received by the provider within 16 days and if all of the above conditions are met, the full purchase price will be refunded to the customer.
§ 19 Choice of law & place of jurisdiction

The law of the EU applies to the contractual relationships between the provider and the customer. The mandatory consumer protection regulations of the country in which the customer has his habitual residence are excluded from this choice of law. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the registered office of the provider if the customer is a merchant, a legal entity under public law or a special fund under public law.
§ 20 Data protection

The regulations in our data protection declaration apply to data protection.
§ 21 Access to the text of the contract

We save the contract text and send you the order details by email. You can view the terms and conditions at any time.
§ 22 Severability Clause

If a provision of these general terms and conditions is invalid, the effectiveness of the remaining provisions will not be affected.
